1. Introduction

Welcome to RawVamp ("Service", "Platform"). By accessing or using our website and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service.

These Terms constitute a legally binding agreement between you ("User") and the operators of RawVamp.

2. Definitions

  • "Service": Refers to the SaaS platform "RawVamp" (hosted at rawvamp.com).
  • "Creator": Refers to the project founder and intellectual property owner (professionally known as CepeshRC).
  • "Merchant of Record": Refers to the authorized financial entity located in the United Kingdom responsible for billing and payments.

3. Service Operators

To ensure transparency and legal compliance, the roles in operating this Service are defined as follows:

  • Creator & IP Owner: Project Lead / CepeshRC (Ukraine). Responsible for software development and system administration.
  • Merchant of Record (Billing): Authorized Financial Representative (United Kingdom). Responsible for processing payments, financial compliance, and refunds acting on behalf of the Service.

4. License Grant

Upon purchase of a subscription, the Creator grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal or commercial purposes (depending on your plan).

This is a grant of license, not a transfer of title. You do not own the software; you are paying for the right to use it for the duration of your subscription.

5. User Accounts

To access certain features (VIP/Platinum), you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials. You agree not to share your account with others.

6. Subscriptions & Payments

6.1. Payment Processors: We use secure third-party payment processors. Payment processing services are provided by Stripe. By using our Service, you agree to be bound by the Stripe Checkout User Terms. We also accept cryptocurrency via NOWPayments. We do not store your full payment details on our servers.

6.2. Billing Cycle: Subscriptions represent a recurring license to use the software. They automatically renew unless canceled 24 hours before the end of the period.

6.3. Taxes: Prices may be exclusive of applicable taxes (VAT/GST), calculated at checkout.

7. Intellectual Property Rights

The Service and its original content (excluding User Content) are and will remain the exclusive property of The Creator (RawVamp).

Strict Prohibitions (License Restrictions):

  • You may NOT resell, sublicense, or redistribute access to your account.
  • You may NOT copy, clone, or replicate the visual design (UI/UX) of RawVamp.
  • You may NOT reverse engineer, decompile, or disassemble the source code.
  • You may NOT use web scrapers or bots to access the Service.
  • You may NOT use the Service, its output, or its filters to train machine learning models or artificial intelligence (AI) systems.

8. User Content & Local Processing

You retain all ownership rights to the photos you upload. We do not claim ownership of your content.

Processing is performed locally in your browser (client-side). We do not store, view, or analyze your original images or edits on our servers.

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall the Creator or the Merchant of Record be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages.

11. Governing Law

Financial Disputes: All matters relating to payments, refunds, and billing shall be governed by the laws of England and Wales.

Intellectual Property Disputes: All matters relating to copyright and code ownership shall be governed by the laws of Ukraine.
